Legal and Ethical Framework for Digital Investigations
Legal and ethical limits when investigating
Every technology investigation takes place within a legal framework that defines what can be collected, how and under what authorization, and not knowing it can invalidate the evidence or expose the investigator to civil or criminal liability. In practice this means understanding concepts such as the reasonable expectation of privacy, the need for a court order or consent to access certain devices or accounts, and local personal data protection rules that limit what can be stored and for how long. The ethical component goes beyond the law, covering the proportionality of the methods used, the confidentiality of the information obtained and the responsible handling of data belonging to third parties unrelated to the case. A frequent example is using surveillance or forensic extraction tools without explicit authorization, something that can turn a legitimate investigation into a crime and ruin a case that was technically well solved.
