Legal Framework and Admissibility of Digital Evidence

What makes digital evidence admissible

Finding the right technical proof is useless if that evidence doesn't meet the legal requirements to be admitted in a judicial proceeding, which is why the legal framework must be understood before touching any device. Admissibility depends on factors such as the legality of accessing the device, usually backed by a court order or the owner's explicit consent, the demonstrable integrity of the evidence through cryptographic verification techniques, and compliance with a documented, uninterrupted chain of custody. In practice, a technically solid finding can be completely dismissed if the expert can't show that the data analyzed is exactly the same as what was originally collected, without any alteration, which has invalidated entire cases in courts in different countries. Knowing the specific requirements of the jurisdiction where the evidence will be presented is as important as mastering the technical analysis tools.
